The different types of Power of Attorney

 General Power of Attorney

General Power of Attorney is normally used by giving the donee the authority to act on behalf of the donor in all circumstances, the restrictions of power will kick in if the instructions within the POA document restrict the donee in certain acts.

The types of power a donee could authorise are;

  • Opening a safe deposit box with a bank
  • For sale or purchase of property
  • Filling of Tax Returns
  • Entering into a contract on behalf of the donor
  • Collection of debts

There are many more the donee could authorise. You can call us to enquire more.

Revocation of a General Power of Attorney (POA) document happens when:

  • When the donor revoke the POA documents
  • When the donor is deceased
  • When the donor becomes incapacitated
  • Upon an event specified in the POA document

Specific Power of Attorney / Non-Durable Power of Attorney

For matters that are very specific the donor can do up a Specific Power of Attorney as this POA document only authorised the donee to act on behalf of the donor based on the specific matters stated.

Revocation of a Specific Power of Attorney (POA) document happens when:

  • When the donor revoke the POA documents
  • When the donor is deceased
  • When the donor becomes incapacitated
  • Upon an event specified in the POA document

HDB Power of Attorney

HDB Power of Attorney is a common document used in Singapore when a homebuyer is not able to attend certain important events pertaining to the purchase of the HDB property. This POA document is necessary when the party is not physically present to attend the signing of legal documents.

Below are the few documents that POA can act for:

  • Sales agreement
  • Option to Purchase
  • Lease Agreement
  • Deed of Assignment
  • Lease-in-Escrow
  • Mortgage-in-Escrow

If any of the parties are residing overseas and could not attend the signing of the documents in Singapore, the donor can appoint the donee to act on their behalf.
