What is a Will

A Will in Singapore is a legal document that ensures all your estate is being distributed property according to your last wishes after you pass away.

Who should be writing a Will

We would definitely suggest anybody and everybody is eligible in making a Will in Singapore.

Here are the examples:

  • Married couples with children
  • Married couples without children
  • Divorced, widowed, or singles with children
  • Unmarried singles with no children.

Failure to prepare a Will

Failure to prepare a Will writing Singapore when you are alive will be your biggest mistake or pitfall.

Leaving critical decisions on the distribution of your estate in the hands of Judges will definitely cause some or many disagreements among family members.

These unsound decisions have often caused many ugly family disputes.

What are the steps in writing a Will, and who are the parties involved in the Will?

  • First will be a TESTATOR.

A Testator is a person who makes the Will. After payment of debts and expenses (if any), the Testator's estate will be distributed to the beneficiaries upon his death.

  • The second will be a BENEFICIARY.

A Beneficiary is the designated person or an organization who will receive the stated gift under the Testator's WILL. For any minor beneficiary receiving a gift from the Testator, it is necessary to have a trustee hold onto the gift until the minor reached maturity.

  • The third will be the EXECUTOR.

An Executor is the trusted person appointed by the Testator to administer the Testator's estate and carry out the Testator's last wishes.

How to get a valid written Will in Singapore?

For the Will writing Singapore to be valid, the following terms have to be met:

  • The Will must be in writing.
  • The Testator has to be above 21 years of age and mentally sound.
  • The Will has to be signed at the right place
  • The Testator's signatory has to be witnessed by at least two witnesses who are neither beneficiaries nor the spouses of the beneficiaries. The witnesses have to be present with the Testator during the signing of the Will.
  • Filing of the Testator's Will under the Wills Registry will be highly recommended, even though this is not compulsory.

Distribution of your hard earned Central Provident Fund (CPF) monies in your will?

You may think your CPF monies are also part of your hard-earned assets over your working years, but CPF funds are dealt with separately under the law. You are required to do a nomination directly with CPF Board. Instead of making a Will in Singapore, making a nomination lets you choose who gets your CPF monies.

Risk of writing a Will on your own

You may be tempted to seek out the cheapest way to get a Will writing Singapore done. After all, Will Writing Singapore companies profess to offer such services with their standard templates.

But it is of utmost importance to get the right advice on how to plan the distribution of your estate.

Yes, you may save a few hundred dollars in fees, but you may end up with the wrong advice.

Whether the Will is complex or straightforward, a lawyer's advice on the content of making a Will in Singapore is highly recommended. These professionals will be able to pinpoint any lapse or pitfalls and will be able to provide the best solutions to you.
